These terms and conditions (“Terms and Conditions”) together with any price list, schedule, quote, acknowledgment or invoice provided by Tribe Instruments, issued or provided in connection with the sale of Goods and the provision of any Service, and all documents incorporated by specific reference. here or therein, constitute the complete and exclusive statement of the terms of the agreement governing the sale of Goods and / or the provision of Services and any future sale of Goods and / or provision of Services to the Buyer, even if it is not agreed again separately (“Agreement”). EXCEPT AS EXPRESSLY SET FORTH IN THIS DOCUMENT OR AS OTHERWISE ACCEPTED, SELLER HEREBY OBJECTS AND REJECTS THE PROVISIONS OF ANY BUYER’S PURCHASE ORDER, CONFIRMATION OR TERMS AND CONDITIONS THAT DO NOT CONTAIN ANY PROVISIONS WITH OR IN ADDITION. Acceptance of Seller’s Offers and Buyer’s Orders, and any changes or amendments thereto, is expressly conditioned on Buyer’s consent to this Agreement. The acceptance by the Seller of any resulting Order or the receipt of the Goods and / or Services by the Buyer, whichever occurs first, will conclusively demonstrate the unconditional acceptance of these Terms and Conditions by the Buyer. All Offers, Orders and other documentation between the Buyer and the Seller will be non-binding unless expressly stated otherwise and will be effective and binding only when approved by the Seller. The Seller reserves the right to make technical and other reasonable changes to the Products or Services. In the event that the Seller has made an Offer to the Buyer that is expressly indicated in writing as binding, the Seller will be bound by the terms of such Offer for two (2) weeks, unless otherwise provided in writing.

1. CONFIDENTIALITY:
   Tribe Instruments guarantees the security of our clients’ information, which travels in an encrypted manner to our administrative software site and is handled in such a way that it cannot be decrypted by agents external to us.
2. PRICES AND AVAILABILITY:
   The availability of our products is subject to change. The prices of all our products are based on the complexity, duration and costs of our suppliers and these can vary at any time.
3. USER LICENSE:
   The End User License Agreement (represents the contractual terms between you (“Licensee”) and Tribe Instruments for the use of the sounds, including related media, documentation (eg, program descriptions, manuals) and other documents and materials manufactured by Tribe Instruments By downloading the product on your computer, you agree to these conditions. If you do not agree to these conditions, you should not download the product.

Tribe Instruments Products are registered and protected by law. The intellectual property of the Products remains in Tribe Instruments.

Tribe Instruments Grants different types of Licenses depending on their products. The license agreement are always in the installer. The Licenses are the following:

SAMPLES NON EXCLUSIVE LICENSE

Licensee only acquires the right to use the Product to the following extent. Any other use or exploitation not explicitly granted to the Licensee in this license will not be allowed without the written consent of Tribe Instruments. Specifically, Licensee has no right to copy or have copied, decompiled or decompiled, reverse engineer or reverse engineer the Product or parts thereof. Licensee must ensure by appropriate and reasonable steps that third parties, including its own employees, cannot make unauthorized use of the Product. Licensee is not authorized to modify the sounds, except to preserve or restore the agreed functions of the instrument or library.

Selling, reselling, renting or lending the licensed sound and instrument libraries to a third party is expressly prohibited.

The sounds, audios, samples, instruments and presets provided may be used for commercial or non-commercial audio and music productions without the prior permission of Tribe Instruments under the terms of this Sound License Agreement. The use of this Product (in particular samples, sounds, samples, audios, instruments and presets) for the creation of a sound library or as a sound library for any type of synthesizer, virtual instrument, sample library, is strictly prohibited. product based on samples or other musical instrument. SOFTWARE LICENSE

Tribe Instruments uses the NATIVE INSTRUMENTS Software called KONTAKT only as an audio engine for which it does not grant any type of license of said Software nor is it responsible for any damage or harm caused by it, Tribe Instruments does not have any type of Affiliation with Native Instruments is therefore only granted a license on the sounds that have been recorded and processed by Tribe Instruments and put into operation in KONTAKT.

We release some of our plugins under the GPL V3 license, that means the software are Free Software, if you want to know more about this kind of License you can visit GNU General Public License V3.

• REFUND POLICY
• Our Players are Compatible only with 64 bit systems of Windows 10 and Up and macOS High Sierra and up (Intel & Native Apple Silicon).
  We’ve tested Tribe Player & Tribe Drums in the latest versions of several DAW’s like Logic Pro X, Reaper, Cubase, Nuendo, Ableton Live, FL Studio, Studio One, Pro tools 2020 (and up) & Digital Performer, however it’s difficult to keep track on older versions of these DAW’s so try to keep your system updated to fully compatibility with our products. For this Reason we can’t make a refund if the user/customer have an older OS or DAW version.
• Tribe Instruments doesn’t have any kind of support or refund when the user use Pirate or Cracked versions of any DAW or Plugins that use scripts or apps that blocks communication between the DAWs and the system, if you have installed any cracked software that runs an “Activator” or “Licenser” or “Patcher” or some kind of script or helper app, your system could have been modified to block the authorization system of an application and that can be an issue to work with our software.
• All the products that Tribe Instruments offers specifies the technical requirements necessary for their correct operation and publishes clear samples of sound and quality. Tribe Instruments is not responsible for any type of error, damage or damage caused by a third party Software that acts as an audio engine in this case, Native Instruments KONTAKT for our free libraries, likewise, is not responsible for any type of error or damage caused by the Gateways of payment ePayco, PayPal or MercadoPago, that is why the return of the entire order will be made within a period of 15 to 30 business days only in case of:
• The Sounds in the Library are completely different (in time, pitch, frequency response, volume, etc.) from those offered on our page.
• Payment has been made for the same product more than once.

The value of the refund is calculated with the TRM at the time of purchase, for partial refunds that are not through PayPal or that have been requested with more than 180 business days will not be refunded to the same payment method used, instead the client must indicate a bank account (Only in Colombia) or a PayPal account to process the refund, Tribe Instruments will not be responsible for the operation costs incurred by the bank and/or the payment platform that have been generated at the time of making the purchase and/or at the time of making the refund, in the event that the refund is rejected or reversed by the bank, we make three refund attempts every ten days, if after the three attempts the refund cannot be processed, Tribe Instruments will withdraw the refund and consider it canceled

In the event that due to a system error it has not been possible to download the product directly from the Downloads section of the client’s account or the downloaded product is different from the purchased product, an email should be sent to [email protected] explaining the situation and indicating the order number and an email address, in this way the file will be sent immediately.
